Rule 18 – Appropriate Office in Relation to International Applications

  • The receiving office, the designated office and the elected office for all international applications shall be the appropriate office as per rule 4. (Appropriate Office)
  • Delhi Branch of the Patent office shall be the appropriate office for dealing with the International Bureau and any other International Searching or Preliminary Examination Authority.
  • An International Application shall be filed at and processed by the appropriate office according to the procedures and regulations under this Treaty.
  • After receiving an international application, the appropriate office shall;
    • Keep a copy of the application in the office, called the “Home Copy”;
    • Transmit one copy to the International Bureau, called the “Record Copy” and
    • Transmit one copy to the competent International Searching Authority, called the “Search Copy”.
      • simultaneously all details of such applications shall be furnished to the Patent Office, Delhi branch.
