REGISTRATION OF LITERARY, MUSICAL OR DRAMATIC WORKS
LITERARY WORKS:
According to the Copyright Act, 1957, literary works include computer programmes, tables and compilations including computer databases.
Further according to the Copyright Act, 1957, a literary work is something which is intended to afford either information or instruction, in the form of literary enjoyment. So computer software coding, algorithms etc., fall under the literary works classification of Copyrights. Literary works are those which can be read. Other forms of literary works include musical composition notes, music, poetries, books etc which hold a readable format.
According to the Copyright Act, 1957, in order for a literary work to be copyrighted in India, it has to be
- Published in India as the First Country.
- An Indian Citizen at the time of publication (alive or dead) if published in any country other than India, the person who published the same should have been
- An Indian Citizen on the date of creating the work which is unpublished
DRAMATIC WORKS
According to the Copyright Act, 1975, dramatic works includes any piece for recitation, choreographic work or entertainment in dumb show, the scenic arrangement or acting, form of which is fixed in writing or otherwise but does not
include a cinematograph film. Dramatic works are those which cannot be read but can be described as a text as to the performance of the art
REGISTRATION OF CREATIVE WORKS ALSO CAPABLE OF BEING A TRADEMARK
Not all creative works can be protected as copyrights when it comes to logos of business entities or logos protected under trademarks. When a logo holds a creative component and stands original, in such cases it shall be protected as
Trademarks as well as Copyrights and in such cases, an application for registration of copyright shall be filed for logos, symbols etc., of those trademarked logos.
REGISTRATION OF CINEMATOGRAPHY OR VIDEOS
A cinematograph / film refers to any work that includes visual recording of a moving image including a sound recording accompanying the moving image, which is recorded on any medium (digital or analog).
Videos are works produced by a process similar to cinematography and both fall under the same category of copyright protection. The author of cinematograph / video is usually the Producer of the video / cinematograph as per the Copyright Act, 1957.
Creative works in the form of movies or videos shall be protected as copyrights under this category.
REGISTRATION OF SOUND RECORDINGS
Sound recordings refer to any work that include a single or a series of musical instrument plays or spoken sounds or any other sounds for the purpose which does not hold a visual component or an audiovisual work.
Music compositions, songs sung by artists (with or without background music), lyrics pronounced, speeches, audio lectures etc., fall under this category
