- Any dispute between the patentee or assignee or licensee and the Central Government or its authorised person in the terms of use of an invention for Government’s Purposes or regarding the payments or the compensation payable for acquisition of an inventions shall be taken to the High Court by either of the Parties as prescribed by the rules of the High Court.
- The Central Government may,
- file a petition of counter-claim to revoke the patent from the patentee (if the patentee is the opposing party) on any grounds as per section 64, and
- raise issue about the validity of the Patent whether or not the patentee is the opposing party.
- During such proceedings if there arises a question if the invention was tested or tried or recorded as mentioned in section 100, and if disclosure of such tests or trials might cause harm to the public interest; the such evidence may be disclosed confidentially by the Government advocate to the advocate of the opposing party or an independent expert as mutually agreed.
- If any dispute between the patentee or assignee and the Central Government is based on the terms of use of an Invention, the High Court may consider what all benefits or compensations would have been received directly or indirectly by the patentee or the assignee upon use of the Invention for the purposes of the Government.
- The High Court shall at anytime either on some question or to the whole proceeding pass an order, to be carried under an official referee, commissioner or an arbitrator under certain terms and all references shall thenceforth be considered from the person so appointed as it is from the High Court.
- If the invention / patent under dispute is a patent claimed was invented by a person who was an employee in the Central Government or the State Governments or any Government undertaking organisations during the time of his employment and was also certified by principal officer of the Government or undertaking as it was a work done in the course of his normal duties as a Government servant, then any such dispute so raised shall be disposed by the Central Government itself directly; however the patentee and other related persons shall be given an opportunity to be heard.
