- Unless an agreement is made between applicants is made separately and valid; any many applicants of a patent will have equal share.
- Each person as an applicant of a patent owns his rights individually as an owner of the property with his share to do anything as per the law without the permission of other owners if no agreement is made separately
- If a separate agreement is made between the owners of a patent, then no activity such as licensing or assigning rights of the patent is possible for an individual owner without the permission of other owners
- If a patent and an individual’s right in the patent is sold by a sole owner to someone else individually then the deal shall be handled only with the person as if it is sold by the sole patentee
- With reference to this section, the rules of law regarding the ownership of any movable property in India will be applicable for Patents too nothing shall affect the rights of legal representatives or trustees of any patent property.
