Section 31 – Anticipation by Public Display, etc.,

Any invention applied for patent by a Complete Specification, though displayed in public places such as exhibitions, industrial fairs before applying for patent will not be considered as an anticipation only if,

  • the invention is displayed or the description of the invention is published by the original inventor or by anyone after obtaining the consent from the original inventor/s at any kind of exhibitions unless the central government has notified in the official gazette regarding this provision for not considering as an anticipation respective to that exhibition in the place held.
  • anyone even without the consent of the original inventor/s uses the invention during or even after the exhibition is over
  • the specification of the invention is read or published in any books or proceedings of such exhibition with the consent of the original inventor/s.

A patent application should be filed by the original inventor/s within the last day of the end of 12 months (not later than 12 months) from the date of exhibiting in the exhibition or conference.
