Section 45 – Date of Patent

Date of patent will be date of filing and the same will be entered in the register No legal suit can be filed for infringements (people who used the patent without permission) committed before the patent application was published.

Section 81 – Disposal by Controller of Applications for Extension of Time

When an opposition is filed and the applicant or patentee is applying for an extension of time, the Controller need not give any notice to or even hear the opposition party and no appeal shall prohibit the Controller from granting such extensions.
