Form 25 – Request for Permission for Making Patent Application Outside India

Form 25 has to be filed when an applicant for patent wants to file a patent application in any country other than India.

Such application shall be filed only if;

  • a patent application for the same invention is filed in India at least before 6 weeks and
  • the invention is not related to nuclear energy or other inventions that would create harm to the harmony or security of India.

The Controller shall dispose such applications within 21 days of such request. This is not applicable on inventions in which Central Government has given secrecy directions and the 21 days shall be counted from the date of such secrecy directions are revoked by the Government.
