Form 3 – To be submitted for filing Statement and Undertaking under Section 8

Section 8 – Information and Undertaking Regarding Foreign Applications.

Form 8, shall require the following information:

Case 1 – No Patent Application filed for protection in other Countries:

Name of Applicants
Name, address and nationality of the joint applicant:
- Declaration Statements:
  1. I/we have not made any application for patent grant outside India for the same invention, or,

Case 2 – Patent Application filed for protection in other Countries:

Name of Applicants
Name, address and nationality of the joint applicant:
- Declaration Statement:
  - I/we have made an application for patent grant for the same invention in other Countries
    - Name of Countries
    - Date of Application:
    - Application Number:
    - Status of Application:
    - Date of Publication:
- Date of Grant:

Case 3 – Patent Application assigned to a third party before / after filing an application outside India.

Name of Applicants
Name, address and nationality of the joint applicant:
- Declaration Statement:
  - I/We, hereby declare that the rights of the application(s) has / have been assigned to XYZXYZXYZXYZ and I/We, undertake that upto the date of grant of a patent, I/We would keep the him informed, all details regarding the corresponding application for patents filed outside India within 6 months from date of filing such an application, in writing.
