Form 4 – To be Submitted upon any Request for Extension of Time.
Extension of time shall be sought for the following processes upon payment of such fees as prescribed by the Patent Office,
- Delay in payment of Patent Maintenance / renewal Fees
- Delay in Payment of Patent Maintenance / renewal fees after grant / entry in the register from the 2nd year of filing the patent application until the year on which the invention got patent granted.
- Delay in Filing Declaration as to Inventorship through Form 5
- Delay in filing request for examination of a patent application
- Delay in making an application for the review of the decisions or setting aside the orders of the Controller
Form 4 shall contain the
- Process for which extension of time is sought,
- Amount of time extension sought,
- Section / Rule under which the time extension is sought, and
- the reason for which the delay or extension time is sought.
