Form 5 – To be submitted upon Declaration as to Inventorship

This form shall be signed by the Applicant or the Patent attorney itself directly through the Power of Attorney executed upon him/her.

Form 5, is mandatory to be filed and it is a declaration from the Applicant of a Patent that the first or true inventors of the patent application are those mentioned in the Form 1.

When an Applicant from a foreign or convention country files an application for patent in India, he/she or the entity shall declare to the Indian Patent Office about their right to file an application for grant in India is through the way of assignment from the true (original) inventors by filing Form 5.

Also when additional inventors whose names were later added after filing the application for patent, such inventors shall also sign the Form 5 and the same shall be filed to the Patent Office.
