- All Provisional or Complete Specifications shall be made in Form 2.
- If a divisional patent application is filed under section 16 (Power of Controller to make orders respecting division of applications), the specification shall contain specific reference to the application number of the original application in which a division is sought.
- If a patent of addition is filed under section 54 (Patents of Addition), the specification shall contain reference to the main patent or the patent application along with a definite statement that shall stand firm to be viewed as a an improvement in, or modification of the invention in the main patent or the application.
- When an invention requires to be explained with drawings, the same shall be prepared neat and referred to in detail, in the specification including claims and filed along with the application. Such drawings shall be marked with respective reference signs (numbers or alphabets) in the parentheses (brackets colloquially),
- However if certain drawings were already filed along with the provisional specification and if the applicant desires, he shall adopt those to be referred from the provisional specification for the purpose of the Complete Specification.
- Any irrelevant matter which in the Controller’s opinion is not necessary shall be excluded from the title, description, claims and drawings.
- Except for applications filed with a Complete Specification, a declaration shall be accompanied with as to inventorship of the respective invention in Form 5 (Declaration of Inventorship) within 1 month from the date of filing such patent application.
- In case of an international application in which India is designated one month shall be considered from the date of filing the international application.
- In case extension of time for filing the same is required; form 4 shall be filed for the same to the Controller requesting extension of time.
- The abstract of a complete specification shall start with the title of the invention disclosing specific features of the invention and titled not more than 15 words.
- The abstract shall be a short summary not more than 150 words of the invention and shall clearly indicate the technical field to which the invention belongs, its advancement and most important use of the invention and if applicable the chemical formula too.
- If the specification consists of drawings, words indicating figures of the drawings and each main feature illustrated by the drawing shall be followed by the reference sign.
- The abstract shall be drafted clearly as if it is easy for the purposes of searching in a particular technical field, making it easy to assess the need to consult the specification itself.
- Any deposit of micro-organisms shall be made in the international repository within 3 months from the date of filing a patent application. If a request for publication is made the deposit shall be performed on or before filing an application for publication.
