Rule – 19A – Indian International Searching Authority

  • According to the agreement between Indian Patent Office and the International Bureau; the Delhi Patent Office shall perform the functions of the Indian International Searching Authority under the Treaty.
  • In addition to the fees payable as per the regulations made under the Treaty, fee for the Searching Authority shall also be paid.
  • The Searching Authority shall establish International Search Report on such applications, or as per Sub rule 3 of rule 19B – if the Searching Authority is not able to establish such report, it may declare the same where India has been indicated as the Competent International Searching Authority.
