- If the Central Government is convinced that a granted patent or a patent application should be acquired for the purposes of public, then it shall publish a notification in the Official Gazette and from then all rights in respect of the patent or the invention shall be forced and transferred to the Central Government.
- Such notice shall be given to the applicant or the patentee along with all members related with the invention as per the register.
- The Central Government may pay a compensation as agreed between the Government and the Patentee or other persons as in default of an agreement or as determined by the High Court to the patentee (if granted) or the applicant (if filed) and other persons related to the invention as per the register, for the expenses incurred in connection with the invention during the entire term right from filing a patent application in the same manner as if it has already earned including the profits made during such period by the Patentee or the licensee and all other relevant factors.
