Section 130 – Removal from Register of Patent Agents and Restoration.

The Controller may remove the name of any person registered from the register of Patent Agents after giving a opportunity for him to be heard, if,

  • his name was added to the register by error due to misrepresentation or suspension of material;
  • he has been convicted of any offence and sentenced to a term of imprisonment or has been guilty in his professional capacity as per the opinion of the Controller.

The Controller may restore the name of any person so removed from the register if he files an application stating the sufficient cause for the Controllers satisfaction.
