- If a Convention application is filed and if the Controller requires the applicant to furnish copies of all supporting documents, copies of specifications along with the Complete specification which are so deposited by the applicant to the patent office of the Convention Country; the applicant shall furnish all such documents as verified to the satisfaction of the Controller within the prescribed time period from the date of communication from the Controller.
- If any such supporting document is in a foreign language, the applicant shall furnish a translated specification to English which is verified by affidavit to the satisfaction of the Controller as required.
- The date on which the application to the Convention Country is made is the date which the Controller is satisfied, by certificate of the official chief or head of the Convention country’s patent office.
- An international application filed through PCT designating India shall have the same effect of an application filed under sections 7, 54 and 135 and the title, description, claim and abstract and drawings filed in the international application shall be considered as the Complete specification
- The date of filing of an application in any designating country shall be the date of international filing under PCT
- If the applicant requests or proposes any change (amendment) in the application made under PCT designating India as international search or preliminary examination authority, if the applicant so desires it shall be taken as an amendment by the Patent Office.
