Section 147 – Evidence of Entries Documents, etc.

  • Any certificate signed by the Controller stating to be a copy of the entry in the register shall be a strong evidence of the original entry having made in the register for things relating to a patent for being done or omitted to be done.
  • A copy of such entries from the register with the signature of the Controller and the seal of the Patent office shall be accepted as an evidence in all courts in all proceedings without the need of submitting the original.
  • The Controller or any other officers of the Patent office, unless he is a party in the case, cannot be compelled to appear before the court as a witness or produce the original of the documents in his custody or the register for which a certified copy itself is sufficient unless by order of the Court on special causes.
