If the controller as directed by the Central Government of India on the various classes of inventions related to the defence of India finds any invention relating to the defence of the Country will notify the Central Government regarding the invention. If the Central Government finds the Patent application to impact on the defence of the Country will instruct the Controller not to publish the Patent Application and apply Secrecy Directions on the same and the Controller will then direct the same to the applicant. The application shall be published or notification will be given to the applicant only if the Central Government considers that it would not affect the defence of the Country.
If the Central Government finds any invention filed for patent and falls within the classes of defence of India as per the norms given to the controller, then the Central Government shall instruct the Controller to apply secrecy provisions for the patent application as per the law and the controller shall notify back to the Central Government on the directions implied by him.
