- When a patent application is filed, the Controller holds the rights and shall request the applicant to amend (make modifications) in the draft or any document related as the Controller thinks if any change is needed.
- the same or any order regarding amendment shall not be passed by the Controller if any case on infringement of the patent is filed or pending in the High Court.
- If the applicant needs time to reply (request for leave) for an amendment request, the request shall be placed to the Controller mentioning all reasons and particulars for which the leave request is made.
- Any request for time extension (leave) for an amendment on a granted patent shall be published along with the proposed amendment.
- If any person files a petition of opposing the request for leave for such granted patents mentioned above, the Controller shall notify the applicant who made a request for leave and hear the from both the parties before he decides on what to do.
- Priority date of any claim are also subject to amendments
- As the Controller requests the applicant of a patent is required to make the necessary changes (amendments) as per the Controllers requirements and before the grant of Patent.
