Section 69 – Registration of Assignments, transmissions etc.,

  • Any person through an assignment or transmission of a patent becomes a share holder in a patent or a mortgagee, licensee, with any type of interest in a patent shall apply to the Controller for registration of his title, interest through a notice to the Controller
  • The application for registration of title of any person with interest in a patent in any manner as mentioned above may be made by the assignor or mortgagor or licensor (patent owner) or any other person related to the Patent
  • when an application for registration of title is made with a proof to the Controller
    • if the person owns a share in the Patent, he shall be registered as a proprietor or co-proprietor of the Patent in the register
    • if the person is entitled by any other interest in the patent, he shall be registered through the instrument proof with the terms.
    • in case there are any disputes between the parties in any manner regarding the share or assignment or any other transmissions, the Controller shall not make any entries to the register until the rights of the parties are defined by the Court.
  • The Controller shall be provided with all documents or agreements relating to the licensing or assignment or any interest on a patent executed on a document relating to the subject matter and the terms of the agreement shall be maintained secured and non-disclosed (except to the court) if any such request is made by the patentee or the licensee.
  • Apart from the conditions mentioned above no rectifications will be made to the register and no other documents will be considered an evidence to make changes in the register on the title of any person towards a patent except if directed by any court.
