Section 77 – Controller to have Certain Powers of a Civil Court

  • The Controller upon any proceedings before him shall have the Powers of a Civil Court, with regard to the following matters namely: –
    • to send summons and enforcing the attendance of any person, examine him on truth
    • to require to present or produce any document before him
    • to receive evidence on affidavits
    • to issue commissions for the Examination of Witnesses or documents
    • to award the costs
    • to review his own decision based on any appeals (applications) within the time duration
    • to set aside the one sided orders passed based on the applications (appeals) made by others within the prescribed time and manner.
    • to any other matters as prescribed.
  • Any order for costs awarded by the Controller shall be executable in the same decree of a civil court.
