- At Anytime after grant of a Patent, the patentee or the licensee with a right to work on those patented inventions which are improvements or advancements of a first invention, may file an application to the Controller to grant a license for the first invention also, stating the valid reason on how not holding the right of the first invention is hindering him from working the other invention(s) effectively or profitably.
- The Controller shall not pass such orders unless he is satisfied that,
- the applicant is capable and willing to procure the patent from the patentee and his other licencees, a license for the invention on respectable terms; and
- the other invention’s contribution to the development of commercial activities with India was reasonable.
- If the Controller is convinced that the conditions in first point are established by the applicant for license of a related or first patent; then he may pass such order of license which is non-assignable unless the patent is assigned and same such order with the conditions shall be passed to the other patents also if requested by the owner of the patent or the licensees.
- All regulations mentioned in sections 87, 88, 89 and 90 shall apply to the licenses granted under this section as they apply to the licenses granted under section 84 (compulsory license).
